Personal Injury: Mediated Settlements

Road travel can be dangerous. A particularly bad scenario is when a large vehicle hits a small one. In a recent case, a pickup truck driver admittedly failed to see a motorcycle and struck it while making a turn. Another recent case involved an 18-wheeler commercial truck that crossed the double yellow lines in the road, striking riders on a scooter. In both of these cases, the passengers of the small vehicles were seriously injured and sought compensation. The passenger on the motorcycle received a $2,175,000 settlement award following mediation. The 18-wheeler case resulted in a $1,050,000 mediated award for the scooter passenger. Damages considered included the plaintiffs’ medical bills, permanent disabilities and loss of income. In 2015, over 1/3 of personal injury settlements in Virginia of $1 million or more involved tractor-trailer accidents.
