Modifying Child Custody/Visitation

When a child custody/visitation order is in place, a parent may seek to modify it by demonstrating that 1) a material change in circumstance has occurred and 2) that the modification is in the best interest of the child. The party seeking the modification has the burden of proving those two factors to a preponderance of evidence standard.
