Intentional Infliction of Emotional Distress

Offensive behavior toward you may leave you embarrassed, shaken or fearful enough to feel you have been emotionally injured. Occasionally, the behavior and resulting emotional damage may be severe enough that is constitutes a successful legal claim for “intentional infliction of emotional distress.” However, absent a physical injury to accompany the emotional one, it is especially difficult to prove all the necessary elements of the claim. Among other factors, the Plaintiff must demonstrate the wrongful behavior was so extreme and outrageous that it “shocks the conscience.”
