Fighting for Access to a Child in Divorce

Sometimes in a divorce, one party will seek sole custody and impose severe limitations on the other parent’s rights to see or contact the child. Attempted justifications for doing so may include allegations of child abuse, drug abuse or other seriously harmful situation for the child. Success on either side of the dispute may hinge on voluminous amounts of evidence, witnesses and medical testimony that must be properly presented to the court in order to be considered. The courts disfavor withholding without a justifiable basis and consider as a factor unmerited withholding in the determination of custody and visitation matters. The complexity of such cases makes imperative assistance from experienced Loudoun County family law attorneys.
